Canadian Hockey Association / Hockey Canada Terms of Use

By selecting "I Accept" and clicking "Proceed" below, you agree that your access to and use of this website and website content (collectively, the "Website") are subject to these terms and conditions ("Terms of Use"), any other notices, guidelines, policies and rules published by the Canadian Hockey Association, also known as Hockey Canada ("Hockey Canada"), on this Website from time to time (each of which is incorporated into these Terms of Use by reference), and all applicable laws and regulations governing the Website. Hockey Canada may amend or supplement these Terms of Use without notice to you.

1. Your Use of This Site. Hockey Canada grants you permission to use this Website as set out in these Terms of Use provided that you access and use the Website solely for lawful purposes and for your personal, non-commercial use. For greater clarity, you may not use the Website to, without limitation: (a) infringe the rights of, restrict or inhibit anyone else's use or enjoyment of the Website; (b) distribute any Personal Information of any members, except in accordance with the Privacy Policy, as defined below; (c) invade another person's privacy or, except in accordance with the Privacy Policy, collect or store Personal Information; (d) "stalk" or otherwise harass another; (e) harm minors; (f) unlawfully use, possess, post, upload, transmit, disseminate or otherwise make available obscene, profane or pornographic material; (g) post, upload, transmit, disseminate or otherwise make available content that is unlawful, threatening, abusive, libelous, slanderous, defamatory or otherwise offensive or objectionable; (h) unlawfully promote or incite hatred; (i) impersonate any person or entity, including, but not limited to, a Hockey Canada or Branch official, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity; (j) post, upload, transmit, disseminate or otherwise make available objectionable information, including, without limitation, any transmissions constituting, assisting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable law or regulation; (k) obtain unauthorized access to Hockey Canada's computer systems; or (l) otherwise breach applicable laws or regulations.

2. Security and Passwords. During the registration process, you will select a user name and password. You understand and agree that you may not share your user name or password information with any other individual. You are solely responsible for maintaining the confidentiality of your user name and password and are fully responsible for all activities that occur under your account. You agree to: (a) immediately notify Hockey Canada of any unauthorized use of your user name, password or account or any other breach of security, and (b) logout from your account at the end of each session. Hockey Canada will not be liable for any loss or damage arising from your failure to comply with this Section 2.

3. Privacy (Management of Personal Information). Hockey Canada has a Privacy Policy (the "Privacy Policy") that governs the collection, use and disclosure of personal information for the purpose of hockey programming and related purposes ("Personal Information"). The Privacy Policy is accessible at http://www.hockeycanada.ca/1/5/1/6/7/index1.shtml. The Privacy Policy notifies individuals that Hockey Canada discloses personal information that it collects to "numerous organizations which offer hockey programs under the auspices of Hockey Canada" including "the Canadian Hockey League, Canadian Inter-University Sport and provincial and local Branches, associations and leagues" to facilitate hockey programming and ensure compliance with Hockey Canada's rules and regulations."

4. Personal Information Restrictions and Obligations. You agree that you will: (a) review the Privacy Policy and direct any questions that you have about its content or application to Hockey Canada's Privacy Officer, whose contact information is set out in the Privacy Policy; (b) if you are a member Branch, association or league, you will advise prospective members to review the Privacy Policy (providing them with a copy where necessary) and explain that the Privacy Policy describes the types of Personal Information collected by Hockey Canada and other organizations offering hockey programs under the auspices of Hockey Canada, the purposes for which that Personal Information is used and disclosed and the rights of individuals in relation to their Personal Information; (c) if you are a member Branch, association or league, you will ensure that all of your employees, agents and volunteers who are involved in the collection of Personal Information are familiar with the restrictions imposed under the Privacy Policy on use and disclosure of Personal Information and the obligation to protect Personal Information, and have received training on the safeguards you use to protect Personal Information; (d) only use and disclose Personal Information for the purposes set out in the Privacy Policy and for no other purposes including without limitation, promoting your league, operations or other activities; (e) not sell or otherwise dispose of Personal Information (unless it is Personal Information about you) without the express, prior, written consent of Hockey Canada; and (f) return or destroy, at the direction of Hockey Canada, all Personal Information which you are holding or storing on the expiry or termination of your relationship with Hockey Canada or your dissolution or at the request of Hockey Canada (unless it is Personal Information about you).

6. Personal Information Security. You will protect Personal Information against loss, theft and other forms of unauthorized access, disclosure, copying, use or modification by way of technological, organizational and physical safeguards. At the request of Hockey Canada, you will provide a description of the safeguards you employ to protect Personal Information. Hockey Canada has the right, on reasonable notice to you, to inspect or have a third party it selects inspect any area, system or equipment used to access Personal Information. You will notify Hockey Canada as soon as reasonably possible if you discover or suspect that Personal Information has been accessed, used or disclosed by an unauthorized person or for an unauthorized purpose.

7. Access, Correction, Inquiries. If you process a request for access to or the correction of Personal Information, you will advise Hockey Canada of the outcome of the request.

8. Disclaimer. Your use of the Website is at your own risk. The Website is not guaranteed to be error-free or uninterrupted. Hockey Canada assumes no responsibility and provides no warranties, representations, guarantees or conditions, express or implied (either in fact or by operation of law) or statutory, including, without limitation, with respect to the quality, accuracy, truth, timeliness, sequence, completeness, merchantability, fitness for a particular purpose, non-infringement, or continued availability of the Website.

The Website may provide, or other users may provide, links to other world wide web sites or resources. Because Hockey Canada has no control over such sites and resources, you acknowledge and agree that Hockey Canada is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Hockey Canada shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such external site or resource.

9. Limitation of Liability. The Website is provided 'as is' and 'as available'. Hockey Canada shall not be liable to you, in contract, tort (including negligence or gross negligence) or otherwise, for any loss or damage whatsoever, or for special, indirect, incidental, consequential, punitive or exemplary damages, however caused or arising (even if Hockey Canada has been notified of the possibility of such damages).

10. Indemnification. You agree to indemnify and hold Hockey Canada harmless from any and all losses, damages, liability and costs (including reasonable attorneys' fees) resulting directly or indirectly from any claim or demand against Hockey Canada arising out of or related to your use of the Website, your connection to the Website, your violation of these Terms of Use, or your violation of any rights of another.

11. Termination. Hockey Canada shall have the right to immediately terminate your access to the Website in the event of any conduct by you which Hockey Canada, in its sole discretion, considers to be unacceptable, or in the event of any breach by you of these Terms of Use. You may terminate your registration at any time by notifying your Branch in writing. Contact information for your Branch may be found at: [NTD: Insert URL]. Upon receipt of notice of termination from you, your access to and use of the Website shall cease.

12. Entire Agreement. These Terms of Use (as may be updated from time to time) constitute the entire agreement between the parties regarding the subject matter hereof and supersede all other communications, representations and arrangements, statements or representations, written or oral.

13. Waiver and Severability of Terms. The failure of Hockey Canada to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms of Use remain in full force and effect.

14. Governing Law. These Terms of Use shall be interpreted and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein (other than any conflict of laws rules that would result in the choice of laws of another jurisdiction). You agree to submit to the exclusive jurisdiction of the courts of Ontario.
